Esta monografia analisa as características do Termo de Ajustamento de Conduta, bem como demonstra os motivos pelos quais se apresenta como uma solução para a efetividade do princípio do acesso à justiça. Para demonstrar que o TAC é de fato uma alternativa à via judicial, foram obtidos dados nos sites do Tribunal de Justiça do Rio de Janeiro e do Conselho Nacional de Justiça que comprovaram a crise do sistema judiciário. Em seguida, foram expostas algumas características do ajustamento de conduta bem como sua evolução ao longo dos anos. A princípio, tais peculiaridades corroboram ainda mais a ideia de “substitutividade” ao procedimento judicial, uma vez que o instituto além de ser mais célere, não impõe as formalidades exigidas pelo poder judiciário. Por fim, foram apresentados dois termos de ajustamento de conduta, sendo primeiro firmado pelo Ministério Público Federal em conjunto com o Ministério Público Estadual, e o segundo pelo Ministério Público do Trabalho. A conclusão deste estudo é a de que TAC tem todo o potencial para tornar-se uma alternativa à solução de litígios, contudo, ainda precisa de certas adaptações para que seja plenamente eficaz.

Maternal and infant mortality have become a serious public health problem in Brazil, especially in northeasternand northern regions.In RioGrande do Norte, the high rates ofdeathsofmothersandbabies haveconcerned not onlythehealthauthorities andjusticeagenciessuch as the prosecution service. In 2011, State Public Ministry (MPE) has developed a proposition which was called “Nascer com Dignidade”, focused on the monitoring ofcare givenin prenatal, childbirth andpost childbirthin the cities. The aim of thisstudy was toinvestigate how the intervention of MPE works in maternal and child care. The method adopted to survey data was the case study by analyzing the skills of the reports which were carried out in four of the eight Public Health Regional Units (URSAP).A total of 26municipalities were chosenand the results showfragilityparticularly inprenatal care which can result in complicationsin childbirthand postpartumlike:incomplete health family teams(in05cities), lack of access orinaccessibility to laboratory tests(16 cities) and lack of the pregnant woman'sattachment to thebirthing place(in26 cities). Based on this reality, MPE has adopted relevant attitudes as filing public civil suits, compliance of Conduct Adjustment Declaration in the municipal management and performing interventions in heath care centers and maternity clinics of the state. Thereforeit is known thatPublic Ministryis of paramount importanceto indicatethe necessaryadjustmentsto addressinfant and maternalmortalityin the state (mean of 65/100,000 and16/100,000respectively) and give the city hall the responsibility for the health care quality provided to their citizens. These factors demand theprinciples ofuniversality and integrality to be performed in order to reduce social inequities.

A partir dos dados do Tribunal de Contas da União (TCU) que apontaram que, entre os anos de 2009 e 2013, a Agência Nacional de Energia Elétrica (ANEEL) arrecadou apenas 32,7% do total de multas administrativas aplicadas, passamos a questionar quais seriam as possíveis hipóteses que poderiam, de certa forma, ter influenciado nesse percentual. O próprio TCU chegou a apontar algumas hipóteses, entre elas, destacamos: recursos administrativos pendentes de julgamento, recursos pendentes no Poder Judiciário, falha no sistema de inscrição de inadimplentes no Cadastro Informativo de Créditos Não Quitados do Setor Público Federal (CADIN) e a celebração de Termos de Ajustamento de Conduta (TAC). O presente trabalho concentrou a análise apenas nessa última hipótese levantada, em razão da importância que esse instituto vem ganhando ao longo dos últimos anos. Visando testar a hipótese acima mencionada, realizamos uma pesquisa na Biblioteca Virtual da ANEEL e analisamos as decisões da diretoria da agência que julgaram os pedidos de celebração dos TACs entre os anos de 2011 e abril de 2015, tendo como objetivo identificar em que medida esses acordos celebrados com a agência impactaram na redução do valor das multas aplicadas.

O Brasil possui uma rigorosa legislação no que consiste ao controle das relações de consumo. No entanto, ainda não parece possível perceber que a vulnerabilidade natural do consumidor, em relação ao fornecedor, conseguiu ser efetivamente minimizada. No entanto, alguns instrumentos, como a Ação Civil Pública, o Inquérito Civil e o Compromisso de Ajustamente de Conduta, da forma como foram constituídos, teoricamente, podem contribuir significativamente para o alcance de uma maior eficácia jurídica da legislação consumerista e, consequentemente, para a efetividade social dos direitos dos consumidores, ainda que, na prática, alguns desafios precisem ser enfrentados.

Esta dissertação foi elaborada tendo como objeto de estudo a implementação do Fundo do Idoso no município de São Paulo, criado pela lei no 15.679, de 21 de dezembro de 2012, e a elaboração de uma proposta de estruturação e gestão. Trata-se de um importante mecanismo que permite ao município de São Paulo receber recursos, dos fundos federal e estadual, de multas provenientes de ações judiciais ou termos de ajustamento de conduta referentes a situações de violação de direitos do idoso, e, ainda, doações de pessoas físicas e jurídicas dedutíveis do imposto de renda. O estudo foi empreendido com o objetivo de se compreender a situação dos idosos no país e, em particular, na cidade de São Paulo – local em que os recursos do fundo do idoso serão utilizados –, suas demandas, as principais violações de seus direitos e a situação de parte da política pública voltada para o idoso no município, a partir da observância do plano de metas da gestão atual, a identificação de importantes atores da política do idoso na cidade, a identificação de um fundo paradigmático – no caso o de Porto Alegre – que nos permitisse antever possíveis problemas, desafios e a forma com que os gestores suplantaram os obstáculos, tudo de maneira a formular uma proposta que tivesse em vista este cenário reconstruído. Ademais, foi pesquisado quais cidades com população acima de 500 (quinhentos) mil habitantes possuem fundo do idoso e como eles estão estruturados, para que futuros estudos comparativos possam valer-se deste levantamento. Outrossim, buscou-se identificar os problemas e desafios existentes no Fundo da Criança e do Adolescente do Município de São Paulo, gerido pela Secretaria Municipal de Direitos Humanos, que também será a gestora do Fundo do Idoso no Município quando regulamentado, como forma de evitar que os mesmos problemas aconteçam. Concluiu-se – a partir da análise de toda a documentação, das percepções e expectativas dos atores envolvidos – que, apesar das dificuldades de implementação e gestão decorrentes da falta de estrutura e da insuficiente quantidade e qualificação de pessoal, o referido fundo do idoso pode contribuir sobremaneira para o fomento de novos projetos na cidade, mobilizando recursos adicionais de fontes não orçamentárias, e para uma maior qualificação do conjunto de políticas direcionadas à população idosa. Ao final, como parte integrante do presente trabalho, apresenta-se uma proposta de minuta de decreto regulamentador.

This study further explored the impact of sectarian violence and children's emotional insecurity about community on child maladjustment using a 4-wave longitudinal design. The study included 999 mother-child dyads in Belfast, Northern Ireland (482 boys, 517 girls). Across the 4 waves, child mean age was 12.19 (SD = 1.82), 13.24 (SD = 1.83), 13.61 (SD = 1.99), and 14.66 years (SD = 1.96), respectively. Building on previous studies of the role of emotional insecurity in child adjustment, the current study examines within-person change in emotional insecurity using latent growth curve analyses. The results showed that children's trajectories of emotional insecurity about community were related to risk for developing conduct and emotion problems. These findings controlled for earlier adjustment problems, age, and gender, and took into account the time-varying nature of experience with sectarian violence. Discussion considers the implications for children's emotional insecurity about community for relations between political violence and children's adjustment, including the significance of trajectories of emotional insecurity over time.

Cette recherche porte sur la problématique du développement psychosocial des enfants doués. Bien qu’il existe des travaux qui indiquent que les enfants doués souffrent plus souvent de problèmes d’adaptation que les autres, comme l’isolement social, la dépression, l’anxiété et une faible estime de soi, la littérature de recherche considère peu l’environnement familial des enfants doués comme étant un facteur qui puisse contribuer au niveau d’adaptation de l’enfant. La présente recherche a eu donc pour objectif de déterminer si les styles parentaux, tels que définis par Baumrind, sont associés à l’adaptation des enfants doués. Les styles parentaux des parents ont été mesurés à l'aide d'un questionnaire auto-rapporté. Le niveau d’adaptation d’un groupe d’enfants doués, âgés de 7 à 11 ans, a été évalué à l’aide de mesures de comportement et de concept de soi. La douance a été mesurée avec un test d’intelligence standardisé. Quarante-huit enfants doués et 52 enfants du groupe contrôle ont participé à l'étude. Les résultats ont démontré que les parents des enfants doués utilisent majoritairement un style parental démocratique. Les mères ont rapporté être significativement plus démocratiques que les pères. Les parents ont identifié un sous-groupe d'enfants doués ayant des problèmes sociaux avec leurs pairs, tandis que ces enfants doués et leurs enseignants n’en n’ont pas indiqué. Aucune association n’a été mise en évidence entre l'utilisation d'un style parental particulier et les problèmes sociaux chez les enfants doués. Cependant, l’utilisation du style parental autoritaire des mères a été associée à des problèmes de comportement moins élevés ainsi qu’un concept de soi intellectuel plus élevé chez les enfants doués. Inversement, le style parental démocratique des mères a été associé à des problèmes de comportements plus élevés chez les enfants doués. Le style parental permissif des mères a été associé à des niveaux de concept de soi moins élevés chez les enfants doués. Pour les pères, les styles parentaux autoritaires et permissifs ont été associés à des niveaux d’adaptation et de concept de soi moins élevés chez les enfants doués. Enfin, le niveau d’adaptation ainsi que les styles parentaux ont été comparés entre les deux groupes d’enfants. Les deux groupes ont présenté des niveaux d’adaptation dans la gamme de la normalité. De plus, les parents des deux groupes d’enfants ont rapporté des styles parentaux similaires. Pour les pères des enfants du groupe de contrôle, le style parental démocratique a été associé à des niveaux d’adaptation plus élevés. Le style parental autoritaire des mères et le style parental permissif des pères ont été associés à des niveaux de concept de soi moins élevés chez les enfants du groupe de contrôle. En somme, les conclusions de cette thèse permettent une meilleure compréhension de la complexité des liens entre les styles parentaux et l’adaptation des enfants doués.

In Western research, cruelty to animals in childhood has been associated with comorbid conduct problems and with interpersonal violence in later life. However, there is little understanding of the etiology of cruelty to animals, and what in the child's life may require attention if the chain linking animal cruelty and later violence is to be broken. The study reported in this paper investigated the association between parent-reported cruelty to animals, and parent- and self-reported psychological strengths and weaknesses in a sample of 379 elementary school children in an Eastern context, Malaysia. No gender differences were found in relation to cruelty to animals or psychological problems, as assessed with the Strengths and Difficulties Questionnaire (SDQ). However, there were different predictors of cruelty to animals for boys and girls. Regression analyses found that for boys, parent-reported hyperactivity was a unique predictor of Malicious and Total Cruelty to animals. For girls, self-reported conduct problems was a unique predictor of Typical Cruelty to animals. Parent-reported total difficulties were associated with Typical, Malicious, and Total Cruelty to animals. We suggest that routine screening of children with an instrument such as the SDQ may help to detect those children who may need to undergo further assessment and perhaps intervention to break the chain linking childhood cruelty to animals and later conduct problems.

This thesis examines the nature, extent and impact of multiple forms of maltreatment (multi-type maltreatment) from within a developmental victimological framework. The interrelationships between sexual abuse, physical abuse, psychological maltreatment, neglect, and witnessing family violence are assessed. The role of family variables in predicting maltreatment and the relative contribution of child maltreatment and family variables to adjustment are evaluated. Risk factors for multi-type maltreatment, and the relationship between multi-type maltreatment and adjustment are explored. The major theories of child development are reviewed. As well as exploring the relevance of developmental theories to understanding the impact of child maltreatment, factors influencing the emergence of child psychopathology are reviewed from a developmental psychopathology perspective. Ecological and developmental perspectives on how child maltreatment translates into the behavioural and emotional adjustment problems of children are integrated in the Child Maltreatment: Risk and Protection Model. After exploring some of the relevant conceptual issues, the literature on the prevalence and impact of each maltreatment type is reviewed, and the literature on multi-type maltreatment critiqued. Methodological and ethical concerns with the conduct of research in the field of child maltreatment using direct assessment of children led to the need for an instrument to assess parent perceptions of each of the types of abuse and neglect, as well as adult retrospective reports. Data are presented from two cross-sectional questionnaire-based studies using the Parent and Adult versions of the Family and Life Experiences Questionnaire which was designed to assess perceptions of children's experiences of sexual abuse, physical abuse, psychological maltreatment, neglect and witnessing family violence. Problems with the isolated focus of research on single forms of child maltreatment are addressed by the inclusion of each of these forms of child maltreatment within a single research design. Respondents for both studies were volunteers recruited from counselling agencies, medical, community health, child care and fitness centres and a first year psychology course. Parents (N=50) described their perceptions of primary school children's family characteristics, experiences of maltreatment and adjustment. Children's behavioural adjustment (internalising and externalising), sexual behaviours, emotions, self-esteem, gender identity, family adaptability and cohesion, parental traditionality, parental sexual punitiveness, interparental relationship satisfaction, and demographic characteristics are assessed in the study of Parents' perceptions. A large degree of overlap between the different types of abuse and neglect was found, with a high proportion of parents describing children's experiences of multiple forms of child maltreatment. Using both maltreatment and family characteristics to predict internalising behaviour problems, neglect and family cohesion were the only unique predictors. Family adaptability and cohesion were the only unique predictors of externalising behaviour problems. Physical and sexual abuse were not predicted from family characteristics; neglect was predicted, but no variables provided unique prediction. Unique predictors of psychological maltreatment were family cohesion, parental sexual punitiveness and divorce. Divorce was the only variable with significant unique prediction of the child witnessing family violence. Family background and family functioning were found to predict some forms of maltreatment, but to also be important factors mediating the adjustment of children, independent of maltreatment. The results are interpreted within an ecological framework, integrating risk factors for maltreatment with experiences of abuse and neglect and subsequent adjustment in childhood. Retrospective reports of adults' (N=175) own childhood family characteristics, experiences of maltreatment, and reports of their current adjustment are also studied. Included with the adult version of the FLEQ were the Trauma Symptom Checklist-40, Rosenberg's Self-esteem Scale, and the Family and Adaptability and Cohesion Evaluation Scale-II. Similar results were found in the in the Adult Study. As hypothesised, adult retrospective reports of the five different types of child maltreatment were found to be highly intercorrelated. Family characteristics predicted maltreatment and adjustment scores and discriminated between single and multi-type maltreatment. Maltreatment scores also predicted adult adjustment. As the number of maltreatment types increased, there was an increase in the number of adjustment problems reported. Alternate hypotheses regarding the possible operation of mediating and moderating processes in the relationships between family characteristics, maltreatment and the adjustment of adults were assessed. Finally, the results of these investigations are discussed and interpreted in the light of extant findings previously reviewed. Data from the two major empirical studies are used to demonstrate the overlap between different child maltreatment categories, and the extent and impact of multi-type maltreatment. The results show that children are vulnerable to more than one type of maltreatment. Individuals who experience a number of different forms of maltreatment had greater adjustment problems than those experiencing only one or two different types of abuse or neglect. Dysfunctional families place children at risk of child maltreatment. Negative family characteristics lead to adjustment problems in children and adults. The type of maltreatment having the most damaging effect on children was neglect, and in the long-term, sexual abuse. A multi-dimensional approach to prevention and intervention needs to be adopted, based on the co-morbidity of maltreatment types, and the likelihood of children experiencing further abuse or neglect of a different type. Dysfunctional family dynamics which place children at risk of multi-type maltreatment, and mediate the effects of maltreatment on adjustment, need to be specifically targeted with support and family intervention strategies. Risk-assessment measures used by Child Protection workers must include adequate knowledge of the inter-relationships between maltreatment types, and the particularly negative impact on adjustment of experiencing many forms of abuse or neglect. Suggestions for future clinical and research work in the area of child maltreatment are developed. The importance of assessing all forms of maltreatment when examining the relationships of maltreatment to adjustment is emphasised. It is recommended that prevention and intervention strategies acknowledge the interrelationships between maltreatment types.

Thirty-one parents with multiple sclerosis (MS) participated in a study to investigate the adjustment of their children, 24 boys and 24 girls aged 4 to 16 years. The majority of parents believed that their illness had an effect on their children. The perception of parents regarding their children's problems in the areas of emotions, concentration, behavior, or social interactions indicated that the children were at three times greater risk than the general community of developing psychological problems. In contrast, actual symptom scores reported by parents revealed that, although these children were at greater risk than the general community of developing peer problems, little difference was found on hyperactivity, emotional symptoms, conduct problems, or total difficulties. Parental negative affect predicted both parental reports of peer problems and perceptions that the parents' illness had an effect on their children. Parental relationship satisfaction and family income did not predict parental reports of children's level of adjustment. These results indicate that children of parents with MS demonstrate more difficulties in how they relate to others, the distress they experience, and how they manage their lives, rather than revealing higher levels of symptoms. Since the data were based on parental reports of their children's problems, the results may also be due to negative affect among the parents.
